What are your responsibilities as a landlord?

You have invested in a property, making you a landlord. With that comes several obligations that you are now accountable for. Whether you’re a first-time landlord or have several years of experience, the rules and regulations change year on year, meaning that you must always keep up to date on your responsibilities to avoid unnecessary problems with your tenants.

 

Right to Rent

Before you can rent out your property you must complete the Right to Rent checks to confirm the immigration status of any adult who is living in the property. It is a criminal offence to neglect to carry out these checks; however, if you choose to use a letting agent like ourselves, we will complete the checks for you. You can find a guide to the Right to Rent document checks on the government website.

 

Tenancy Information

As well as providing your tenant with a tenancy agreement, which can be supplied by your agent, you must also provide a number of other documents. At the start of any tenancy you must give the tenants a copy of the Energy Performance Certificate, which must show a rating of an E or above, information on the new changes to the Minimum Energy Efficiency Standards can be found on our blog. If your property has a gas appliance, you must provide an up to date gas certificate.

 

Tenancy Deposit

Your tenant’s deposit must be held with a government-approved deposit protection scheme, which is then returned at the end of the tenancy providing that all the rent has been paid and no damage has been caused. The government-backed schemes are Deposit Protection Service, My Deposits, and Tenancy Deposit Scheme

 

Repairs & Maintenance

Your obligations in regard to repairs and maintenance of the property include the exterior and structure as well as ensuring the supply of water, gas, and electricity is in safe working order. Keeping your property in a good condition is appealing to tenants and helps to keep your costs down whilst retaining the property’s value.

 

Health & Safety

Obviously, as a landlord, the health and safety of your tenants is extremely important, and you must have a gas safety check completed by a Gas Safe registered engineer every 12 months. Smoke alarms must be fitted on each floor and carbon monoxide detectors must be supplied in any room with a coal fire or wood burning stove. All electrical equipment or furniture that you provide must also meet safety standards.
